The use of the online sales system described in these general sales conditions is exclusively reserved for final consumers (referred to from now on as clients) who are acting exclusively on their own behalves.
Applicability of the present sales conditions
The present sales conditions are applicable to all sales of I Santi products made through the website www.isanti.it . The client must examine these conditions carefully before completing the online purchasing procedure for I Santi products. It is understood that the placing of an order through the website implies total and absolute knowledge of the present general conditions of sale and their complete acceptance. The client therefore commits himself to observe these conditions in his dealings with I Santi and acknowledges that I Santi is not bound to conditions other than these present if not pre-emptively agreed in writing. The present general conditions of sale are to be considered applicable and in force as long as they remain accessible on the website www.isanti.it . Any elimination of these from the website www.isanti.it applies automatically that they are not applicable to any purchases made following their elimination.
The articles present in I Santi’s Online Boutique may be purchased while stocks last in the warehouse, by anyone over the age of 18. Orders can be placed upon registration and creation of a personal client account, following the steps and instructions specified on the site itself. I Santi reserve the right to evaluate acceptance of the orders received, and will communicate any impossibility in accepting the order directly to the client. According to what is laid out in article 53 of the Consumers’ Code, the client will receive, at the moment of fulfilment of the contract, written confirmation of the product ordered, the sum paid, with details of the product price and the postal charges to be paid by him, as well as times and procedures for the delivery of the goods and references for making any complaints or to receive information on the existing commercial guarantees. Orders placed from Monday to Friday before 13.00 (Italian time – GMT+1) will be sent the same day. After that time, the orders will be sent the following working day. More generally, from the moment in which the confirmation of order email is sent, delivery times will depend on the type of delivery that is selected. Orders may suffer delays in sending and delivery due to public holidays. The following are considered public holidays: 1st January, 6th January, Easter and Easter Monday, 25th April, 1st May, 2nd June, 15th August, 1st November, 8th December, 25th December, 26th December. The fulfilment of services on the part of I Santi may be suspended in the case of the sudden occurrence of accidental circumstances or those beyond our control that prevent or delay fulfilment. I Santi are committed to informing the client of the occurrence of accidental circumstances or those beyond our control 7 days after their occurrence. If the suspension of services should be prolonged for a period longer than 15 days, the client will have the opportunity to cancel the order and will be reimbursed the sum already paid.
Prices of products
The prices of the products are inclusive of all taxes and levies, excluding delivery costs. The price of each product, as well as the total delivery cost, are communicated to the client prior to the conclusion of the contract. All prices are quoted in Euros and are inclusive of VAT. I Santi constantly check that all prices indicated on the site are correct, without however being able to guarantee the absence of errors. Should an error be discovered regarding the price of a product, I Santi will give the client the opportunity to re-confirm the order at the correct price or to cancel it.
Methods of Payment
Payment on the part of the client may be made by credit card (which will be debited at the moment of preparation of the order for delivery), bank transfer or cash on delivery (only for Italy). In order to prevent internet fraud, the payment made through the website www.isanti.it is managed by the network of the bank concerned through the tools offered by Banca Sella. This company is responsible for the conservation and automatic processing in a protected environment of the information concerning each order, including financial information. All financial information, such as credit card number, expiry date, etc, is directly managed by Banca Sella . who guarantee the security of online transactions. I Santi have no knowledge of the credit card details and are therefore unable to file or retain them in any way. For this reason the support of their clients during the entire payment process is directly followed by Banca Sella. If, for any reason, the debit of the sum owed by the client is impossible, the sales process is automatically cancelled and the sale automatically rescinded. The official currency of the I Santi Online Boutique is the Euro. For countries not adhering to the Euro the exchange rate depends on the client’s credit card operator.
Transport and Delivery methods
For the delivery of his purchases, the client can choose his own residence or home, workplace or the private address of the person of his choice. The delivery of products takes place at the address indicated by the client only following correct registration of payment of the order concerned. In the case in which, at the moment of delivery, the exterior of the package is damaged, the client must proceed to open the package in the presence of the delivery personnel in order to check the state of the product contained within. If the product is damaged, the client must detail all damage discovered in writing on the delivery form. I Santi will repair or replace for free any product that has been damaged or lost during delivery by our forwarder, on condition that the client has communicated in writing, via email at the address [email protected] , the damage or loss within 24 hours following the date of delivery (in the case of damage) of 24 hours following the date of delivery communicated to the client when the order was placed (in the case of loss). In the case of damage to the product, the client is also requested to provide I Santi with the receipt or other documents regarding the product in question, along with the original packaging. The client is also required to check that the products received correspond to those in the order placed. If the products delivered are not the same as those ordered, the client must inform I Santi’s Customer Service department by telephone or email and return the products.
Right of Withdrawal
If for any reason the client is not satisfied with the order, or in the unfortunate case of products being sent that do not conform to those requested, they can return the purchased product within 14 (fourteen) days of the date of delivery, in accordance of the rules laid out in article 64 of the Consumers’ Code. The right to withdrawal may be exercised exclusively by the client and under no circumstances by the recipient of a gift. Acceptance of returns may be accepted only via UPS or SDA. delivery and upon authorisation by I Santi. The client may exercise the right to return by sending a written communication to I Santi at the email address [email protected] , indicating the order number and the reason. The client will then receive a communication from I Santi with authorisation to return and will also be provided with a return code. No return of articles purchased will be accepted without the procedure outlined above being followed. All risks and costs regarding returns are the responsibility of the client.
Repayment is made to the client’s bank account corresponding to the credit card used for payment. It is understood in all cases that, according to what is laid out in article 67 of the Consumers’ Code, the integrity of the product is an essential condition for exercising the right to withdrawal on the part of the client.
I Santi strive to provide the most efficient service possible, however technical inaccuracies may occur. I Santi reserve the right to make changes and corrections to the website whenever necessary with no prior notice. I Santi do not guarantee that the information contained on their site conforms to the jurisdiction of the country or that the products on display on the site are available for sale in all jurisdictions. I Santi try to present and to allow visibility of products and colours on the site in the most truthful and accurate way possible. Visualisation of the colours of the products depends however on the user’s monitor and the I Santi Online Boutique cannot guarantee that the client’s monitor reproduces the colours in a completely faithful manner. Apart from cases of criminal intent or serious negligence, I Santi will not be responsible towards the client in any case following:
1. Damage or loss caused by the products (or by their use by the client), notwithstanding in any case the application of the regulations mandatory by law concerning the responsibility of the producer
2. Damage that has not been caused by non-fulfilment on the part of I Santi;
3. Loss of business or business opportunity.
Within the limits outlined above, I Santi’s responsibility may in any case not exceed the price paid by the client for the product that has caused the damage.
